TERMS OF USE

Article 1 (Compliance with Basic Matters)

Users of the site are required to comply with general manners, morals and technical rules of online conduct.

Article 2 (Influences due to the User Environment)

The services provided on the site are for users whose (Japanese) text character, email, printer and other settings satisfy our requirements. The Hakodate Yunokawa Hot Springs Ryokan Cooperative (“the Cooperative”) shall not take any responsibility for the consequences of operations by users whose settings do not satisfy the requirements, or any influences thereof. Even if the user environment satisfies the requirements, the Cooperative shall not be responsible for any influences of failure to provide the services due to any circumstances related to the user’s PC and other environment settings (including any reasons beyond the control of the Cooperative).

Article 3 (Terms of Use)

The services are available only to users who have agreed to the Terms of Use.

Article 4 (Services)

Users may use the online booking, change, cancellation and other services regarding experiential programs and travel products (hereinafter referred to as “Programs”) offered or presented on the site (hereinafter referred to as “the Services”).

Article 5 (Notes on the Use of the Services)

Programs on the site may not be available due to the capacity or other circumstances of the organizer. When it is necessary to change or cancel a booking, users are responsible to make the concerned change or cancellation at their own responsibility on the site or by directly contacting the organizer.

Article 6 (Change, Suspension or Discontinuation of the Services)

When the Cooperative deems it necessary, it may change, suspend or discontinue the Services without obtaining the consent of the users. It shall be deemed that the details of such change are notified to users by posting on this site.

Article 7 (Payment)

Payment for programs booked via the Services shall be made by credit card, in principle.

Article 8 (Presence of a Contract)

Online booking of a program offered or presented on the site shall constitute a contract between the user and the organizer of the program. The type and conditions of the contract shall be specified for individual programs. The contract between the user and program organizer shall be established by the display of “Booking completed” on the site, or by a notification of completion of booking sent by the organizer to the user, unless otherwise stipulated in the travel conditions statement or other documents.

Article 9 (Days/Hours of Service Provision)

The Services on the site shall be provided 24 hours a day, 365 days a year. The availability periods of the Services for individual programs shall be provided separately. Service provision on the site may be suspended, discontinued, changed, abolished or delayed in any of the following cases.

  1. When conducting periodic or emergency maintenance of the site system
  2. When the normal service provision on the site becomes impossible due to war, riots, unrest, labor disputes, earthquakes, volcanic eruptions, floods, tsunamis, fires, power failures or other emergencies
  3. Other cases where the Cooperative deems it necessary for the operation of the site

Article 10 (Self-responsibility of Users)

Users shall be responsible for the consequences of any acts conducted by users themselves or via the use of their email addresses or passwords concerning the Services, regardless of who has committed the acts or the users’ negligence. If any damage is incurred by a third party due to a user’s use of the site, the user shall be responsible to resolve any disputes with the third party at his/her own expense. If a user causes damage to the Cooperative through violation of the Terms of Use, the Cooperative may claim compensation from the user for all damages incurred.

Article 11 (Booking)

The name, date of birth, sex, telephone number and other data must be entered correctly upon booking of a program via the Services.

Article 12 (Response to Prohibited Acts)

In any of the following cases, the Cooperative may refuse use of all the Services on the site without prior notice. In such cases, the concerned user must pay the entire amount owed to the Cooperative immediately, and the Cooperative may claim compensation for damages or take other necessary measures.

  1. It is found that the user has committed a malicious act, such as failure to participate without giving prior notice.
  2. Delay or failure to pay due amounts has occurred.
  3. The user has violated the Terms of Use.
  4. The user has caused any trouble or inconvenience to a third party.
  5. It is found that the user has committed any act that may obstruct the Services of the Cooperative.
  6. Other cases in which the Cooperative deems an act or manner of use of the Services on the site by the user as inappropriate.

Article 13 (Notification)

  1. Notifications from the Cooperative to users shall be via posting on the site, email or other means that the Cooperative deems appropriate.
  2. The notification mentioned in the preceding paragraph by email shall be deemed as completed when the notification is sent to the user’s email address and reaches the server hosting the user’s email address. The user is required to read the notification sent from the Cooperative by email without delay.

Article 14 (Prohibition)

In any of the following cases, the Cooperative may refuse the use of all the Services on the site without prior notice. In such cases, the concerned user must pay the entire amount owed to the Cooperative immediately, and the Cooperative may claim compensation for damages or take other necessary measures.

  1. Improper use of an email address
  2. Any act that violates or may violate the copyright or other rights of a third party or the Cooperative
  3. Any act that causes or may cause an adverse effect or damage to a third party or the Cooperative
  4. Any act that violates or may violate the privacy of a third party or the Cooperative
  5. Transmission or writing of computer viruses or other harmful programs
  6. Any act that violates or may violate public order and morals
  7. Any act that violates or may violate the law
  8. Any other act that the Cooperative deems inappropriate

Article 15 (Response to Prohibited Acts)

When the Cooperative deems that a user has violated the Terms of Use, it may refuse the use of all services on the site by the user without prior notice. In this case, the concerned user must pay the entire amount owed to the Cooperative immediately, and the Cooperative may claim compensation for damages or take other necessary measures.

Article 16 (Personal Information)

The Cooperative shall handle personal information received from users in accordance with the separately provided Privacy Policy.

Article 17 (Compensation for Damages)

Users shall be responsible for compensation for damages incurred by any third party, program organizer or the Cooperative in relation to the users’ use of the Services on the site or as a result of violation of the Terms of Use.

Article 18 (Disclaimer)

  1. The Cooperative shall post information provided by program organizers on the site, but shall not take any responsibility concerning the authenticity and correctness of such information. Posting of programs on the site shall not mean the Cooperative’s guarantee of the content or quality of the programs.
  2. The Cooperative shall not take any responsibility for damages incurred by users or third parties in relation to the Services on the site, except for those caused intentionally or negligently by the Cooperative.
  3. The Cooperative shall not take any responsibility concerning information, services and other content of sites linked to the site.
  4. The Cooperative shall not take any responsibility for damages caused by the suspension, discontinuation, cancellation and the like due to equipment failure, man-made disasters, natural disasters and the like, except for those caused intentionally or negligently by the Cooperative.

Article 19 (Attribution of Rights)

Rights to all programs, software, services, procedures, trademarks/tradenames, the Services provided on the site and associated technologies in general shall belong to the Cooperative, program organizers or other relevant parties. Users shall not commit any acts to violate such rights.

Article 20 (Governing Law and Jurisdiction)

Interpretation and validity of the Terms of Use shall be governed by the law of Japan. Disputes related to the Terms of Use and the use of the Services shall be resolved in good faith between the parties. When a dispute cannot be solved through discussions, the case will revert to the exclusive jurisdiction of either the Hakodate District Court or the Hakodate Summary Court.

Article 21 (Amendment of the Terms of Use)

The Cooperative my amend the content of these Terms of Use without prior notice. Users must confirm the Terms of Use every time they use the site. When amendments are made, only the content after the amendments shall be valid.

Supplementary provision

The Terms of Use shall be implemented from September 15, 2022.
